This is the privacy statement of Allround Makelaardij, located at Grotestraat 264a 5142 CC in Waalwijk and Korvelplein 212, 5025 JX in Tilburg. (hereinafter referred to as the “Broker” or “we“). This privacy statement applies to the processing of personal data of our clients, potential clients and other persons who visit our website or have contact with us.

In this privacy statement you can find information about how we handle personal data. The Broker is responsible for the processing of your personal data and in doing so will exercise the utmost care and, of course, comply with the rules arising from the AVG and other laws and regulations.

Personal data we process, basis and purposes

Clients

If you engage us to sell or rent a property, we ask you to provide us with the following personal data:

– your name, address, gender and contact information such as your phone number and email address;
– the description and characteristics of the property such as area, cadastral data, WOZ value, the asking price or rent, and so on;
– a copy of your passport or identity card, in which we make the BSN number illegible.

We process this personal data, and other data you voluntarily provide to us, to assist you in selling or renting your property. The basis for this processing is to carry out the agreement you have entered into with us.

We request the copy of your passport or proof of identity because we are obliged under the Money Laundering and Terrorist Financing (Prevention) Act (Wwft) to identify our customers on the basis of the original proof of identity and to record its details. We make the BSN number illegible because there is no legal basis for its processing.

If you engage us to purchase or rent a property, we request that you provide us with the following personal information:

– your name, address, gender and contact details such as your telephone number and e-mail address;
– the search profile with your housing requirements, including the maximum purchase price or rent you are willing to pay;
– a copy of your passport or identity card, in which we make the BSN number illegible;
– if you are interested in a property we may ask you to provide additional information requested by the seller or landlord such as pay slips, bank statements, employer’s statement or an extract from the population register;
– after you have bought or rented a property: Your new address and transaction details;

We process this data, and other data you voluntarily provide to us, to assist you in searching for and purchasing or renting a property. The basis for this processing is the performance of the contract you have entered into with us.

We request the copy of your passport or proof of identity because we are obliged under the Wwft to identify our customers on the basis of the original proof of identity and record the details thereof. We make the BSN number illegible because there is no legal basis for its processing.

Payment data

If you submit an order to us, we also process data necessary for sending an invoice for the services provided by the Broker and receiving payments (such as your bank account number). The basis for this processing is the performance of the agreement you entered into with us.

Potential customers

We also process personal data of potential customers. From visitors to our website who complete the search form offered thereon, we record the following data:

– name, address, phone number and e-mail address;
– the search profile with your housing preferences, including the maximum purchase price or rent you are willing to pay;
– whether you agree to receive our newsletter by e-mail;
– the time you filled out the form.

Of potential customers who contact us by other means – such as by e-mail, telephone or by handing over a business card, we process the data they leave with us. This includes the contact details you provide to us and the reason why you contact us (for example, because you have a question).

We use the contact details you provide to contact you if necessary, for example to send you the results of a search or to answer a question. We process this personal data because it is necessary for the protection of our legitimate interest, namely the interest of being able to perform our work and obtain new assignments.
We may further use your e-mail address to send you a monthly newsletter with information that we think may be relevant to you. If you have previously placed an order with us, there is a so-called “existing client relationship” and we will send you these newsletters based on our legitimate interest. If you have not previously used our services but have come into contact with us by other means (such as by filling out the search form on our website or sending an email with a question), we will ask you for your permission to send newsletters to you, and will only do so if you have given us your permission to do so.

How long do we keep your personal data?

Administration

We retain our records, including invoices and other administrative records on which your personal data are listed, for a period of seven years after the end of the financial year in order to comply with the tax retention obligation.
Copy of passport
We retain the copy of your passport or identity document for a period of five years in order to comply with the retention obligation in the Wwft.
Other contact information
We retain other contact information for two years after the last contact, unless you request us to delete it earlier.

With whom do we share your data?

We may provide the information you provide to us to third parties as necessary to carry out the purposes described above.

For example, we use external parties for:

– our software solutions (for example, through our CRM system Realworks);
– providing newsletters and invitations.

We naturally make the necessary arrangements with these parties (processors) to ensure the security of your personal data.

We may also provide your information to third parties if you request us to do so. For example, we may provide your information directly to a notary if you are buying or selling a property.

We do not provide your data to third parties, unless we are required by applicable laws and regulations to provide certain data, for example to the police in the context of an investigation.

How will your data be secured?
We have implemented appropriate technical and organizational security measures to protect your personal data from loss, misuse and unauthorized access by third parties. In addition, we require our IT provider to also implement such appropriate technical and organizational security measures.

What are your rights?
You have the following rights:
a. The right to inspect your personal data and receive a copy thereof.
b. The right to rectification of your personal data if they are incorrect or incomplete.
c. The right to object to processing and/or – in certain cases – the right to restrict the processing of your personal data.
d. In certain cases: the right to have your personal data erased (‘right to oblivion’).
e. The right to obtain your personal data in a structured, common and machine-readable form and to transfer that data to another person.
